"Dirty Hands"--What Does NYAG Letitia James' Indictment Mean For VDARE?
Well, it establishes that she's a liar, and that could be good
New York State Attorney General Letitia James, whose relentless lawfare against VDARE recently culminated in charges against the VDARE Foundation and against Lydia and I personally, has now herself been indicted on charges of mortgage fraud.
We are completely innocent. But James is unquestionably guilty. The remarkable independent investigators Sam E. Antar (@SamAntar) and Joel Gilbert (@JoelSGilbert) have shown that she has an astonishing documented pattern of false mortgage filings extending back for some forty years.
More charges will probably follow.
With typical arrogance, James has brushed off the allegations of mortgage fraud with the shamelessly technical argument that the prosecution would have to prove “intent.” (Her 40 years of fraud may suggest something about that).
The Deep State, in the shape of the DOJ bureaucracy in the Democrat-dominated Eastern District of Virginia, has been, as is always the case with potential Democrat defendants, reluctant to prosecute her. And her case has been assigned, allegedly randomly, to a black Biden judge, Jamar Walker.
So maybe James is right to assume she will be rescued by another example of the two-tier justice that is a symptom of America’s emerging ethnically-driven crack-up. (TM R. Emmett Tyrrell, Jr.).
But her indictment is at least a start.
A lot of friends have reached out to ask what this means for James’ persecution of us. The answer: strictly speaking, nothing—necessarily.
Even if Letitia James were disapparated tonight, there are lots of other communist thugs in the New York Attorney General’s office who would no doubt want to keep our persecution going.
But in a more general sense, the public surfacing of Letitia James’ forty years of fraud may well mark a turning point.
When cops are found to have lied in court, it regularly triggers scrutiny of other cases in which they have been involved. Similarly, New York State’s Attorney Grievance Committee could—theoretically!—decide to investigate if Letitia James’ indictment for mortgage fraud suggests ethical violations.
Needless to say, there is no chance whatever that New York State’s Attorney Grievance Committee will investigate Letitia James. (See “two-tier justice” above).
But James’ forty years of fraud cannot but lend credence to the VDARE Foundation’s contention that she lied to the court in her assault upon us.
There is in law a “dirty hands doctrine” which refers to a situation where a prosecutor engages in unethical or improper conduct, such as withholding evidence or manipulating facts, and thus discredits his case.
This is exactly what Letitia James did in the VDARE case. For example:
She lyingly claimed that my family used the Berkeley Springs Castle as our primary residence. But we lived only briefly in the Castle before moving to a cottage on the grounds, AND WE PAID INDEPENDENTLY-DETERMINED RENT THROUGHOUT. Moreover, she nowhere acknowledged that the Castle was purchased for an unimpeachable purpose: providing a venue for meetings that, because of threats from her Antifa friends, we could not hold elsewhere.
She lyingly claimed that we transferred assets purchased to a for-profit corporation that Lydia controls. But this for-profit corporation, part of the liability-restructuring that we were forced after we got into the Historic Property management business, was in fact owned by the VDARE Foundation—NOT by Lydia personally.
To our utter astonishment, New York State Judge Sabrina Kraus simply cut-and-pasted Letitia James’ allegations, apparently without reading our refutation at all.
Nevertheless, and this is a critical distinction: Attorney General NYAG Letitia James absolutely did have to tell the truth to Judge Kraus, and to all courts involved in our lynching.
Instead, she systematically lied.
In journalism, and of course in politics, you get used to opponents lying all the time.
But NYAG Letitia James is not just a journalist and not just a politician: she is also the head of a state agency, and a lawyer.
That means that, as a lawyer, she is what is known as an “Officer of the Court.” As Law.com says
As officers of the court lawyers have an absolute ethical duty to tell judges the truth… [Emphasis added]
You can see why this is necessary. The system simply cannot function if all factual assertions have to be checked all the time.
Truthfulness “cuts down on transaction costs,” as the great Nobel Laureate economist Milton Friedman once pointed out to me.
NYAG Letitia James, however, has consistently lied in court filings.
Which violates several New York Rules of Professional Conduct.
I simply don’t know if America’s judicial system is capable of convicting Letitia James.
But I do know that what VDARE is looking at here is an anti-white Civil Rights atrocity.
